Ban Set To Cut Down On Vaping Boosts Black Market Instead

After passing a complete prohibition on all vapor products, many Indian public health officials believed they would successfully cut down on the rate of teenage vaping throughout the country. Instead, many have found procuring vapor products to be easier than ever, as long as they’re not looking for an international brand such as Juul.

India became one of the first countries to pass prohibition on all vapor products towards the end of last year. Yet in the face of this unprecedented prohibitive policy, many are finding it to be quite easy to still get vapor products, as long as you’re not looking for a regulated major brand.

The ban imposed penalties for those caught vaping, as well as on the sale and possession of vapor products. Penalties range from fines starting at a staggering 100,000 Rupees (or ~$1300USD) or up to a year in prison.

Despite these strict measures, people are readily able to purchase vapor products from any paan shop. Even if they have difficulty doing that, there’s nothing stopping them from going online and having them shipped directly to their door.

Critics of the ban believe it only bolstered black markets, rather than properly preventing vaping. They note that a regulated market would be able to better protect against youth vaping by employing age and other checks to prevent purchase.

Backfired Ban

In September 2019, the Indian government passed a sweeping ban on all vapor products following concerns over youth access and a series of lung injuries being misattributed to nicotine vaping. With the ban came stiff penalties for the sale, possession, and usage of vapor products, ranging from fines starting at 100,000 Rupees (or roughly ~$1300USD) all the way up to a year in prison for lack of compliance.

Nearly nine months after the ban has been implemented, many in the country are starting to question exactly what it has accomplished so far. While formal, regulated companies such as Juul or Vape have been forced out of regulated markets, a burgeoning black market has been bolstered by the prohibition, importing unregulated products from companies in China. These products are often cheaper for the end-user due to a lack of quality control and standards.

“I have been in the business for three years now. The only thing that the ban has changed is branded products are out of the market. I can still sell Chinese products which I usually buy from a black market in Mumbai.” said an Indian 23-year-old who sells his illegal products through Instagram, speaking to reporters under the condition of anonymity.

Many countries that have banned vapor products and dismantled their regulated industries have seen unregulated black markets take hold. Critics of the ban believe it removes basic quality standards to protect consumers, and allow teens even easier access to vapor products through black markets that readily want money and don’t check identification.

“It is difficult to enforce regulations as nicotine is available in all other forms. Formal players making e-cigarettes are exiting the market. Once the black market industry gains a footer, it will be impossible to get control over it. The government missed a golden opportunity to regulate these products,” said Samrat Chowdhery, of Association of Vapers India. He believes a safe and regulated marketplace is the best way to protect the public at large.

Vaping Facts

Harm reduction experts and public health scholars have long-cautioned against the prohibitive policies and restrictive regulations currently impacting the industry, not only for their obvious economic impact but for their major public health ramifications as well. In an article published in the journal Science, a group of respected public health experts banded together to speak out against prohibitive policies and restrictive regulations targeting vaping, noting there is currently no evidence that vaping is harmful, and that these policies may force smokers back toward tobacco or, as demonstrated, the black market.

Despite claims being parroted by lawmakers and anti-vaping activists, research from the NYU School of Global Public Health found that most teens don’t actually vape at all. The study, published in the journal Nicotine & Tobacco Research, found that over 85% of teens don’t vape and that even the few that do are not habitual users.

An extensive collection of scientific research and academic review has affirmed vaping’s value as the most effective smoking cessation aid available. For example, a study published in the New England Journal of Medicine found that vaping was more effective than other nicotine-replacement therapies in helping adults quit and remain off of tobacco.

Not only has vaping been repeatedly demonstrated as an effective smoking cessation aid, but research has also noted its value as a reduced harm alternative to tobacco as well. In fact, research from Public Health England and the Roswell Park Comprehensive Cancer Center found that vaping is actually 95% and 93% safer than smoking, respectively.

Conclusions

An unregulated black market is both a major economic and public health hazard. In addition to this untaxed revenue often going to organized criminals, a lack of quality control places users at risk while the teens the ban was supposed to stop from vaping are still readily able to purchase vapor products.

Indian vapers must band together to speak out against these prohibitive policies, not only for the outrageous penalties levied against those concerned for their health but for the wider economic and public health ramifications it has had to date. Organized civic action and engagement represents one of the greatest opportunities for affecting actual change against these restrictive regulations.

Controversial Law Prohibits The Sale Of All Flavored Vapor Products Within The Empire State

Amid the chaos created by the coronavirus, the crisis has led to an array of bad actors exploiting the disaster for their own benefit. For vapers in the Empire State, their Governor has taken advantage of the state of affairs by forcing a ban on flavored vapor products into the state’s upcoming budget, which had additional pressure to pass given the current situation at hand.

On May 18th, a statewide ban on flavored vapor products went into effect following passage of the state’s budget in April. The Governor had previously attempted to pass the ban through executive order in September of last year, but that was struck down in New York State Supreme Court in January.

The ban is a complete statewide prohibition on all flavored vapor products, except for tobacco offerings. In addition to the flavor ban, all pharmacies, as well as stores containing pharmacies, are now prohibited from selling any non-therapeutic nicotine products, such as tobacco and vapor products.

Critics of the measure fear for the public health and economic ramifications of the measure, particularly during these trying times. Those who switched to vaping from smoking because of flavored offerings may find themselves going back to smoking, and the ban on products that make up a majority of vape shops’ revenue may force these small businesses to shutter.

Supporters of the measure state it is necessary to protect teens from access to vaping and potential nicotine addiction. While happy with the steps taken, these anti-vaping activists claim that complete prohibition is the only effective way to truly prevent teens from vaping.

Complete Flavor Ban

In New York State, a complete ban on all flavored vaping products went into effect on May 18th, 45 days after being signed into law. The prohibitive policy was added as a rider to the state’s larger budget bill for the upcoming fiscal year.

Governor Andrew Cuomo’s previous attempt at passing a similar ban by executive order last September was blocked by New York State Supreme Court Judge Catherine Cholakis in January. In her ruling, the judge stated the Governor and Public Health and Health Planning Council had overstepped their authority with the order, calling it unconstitutional and issuing an injunction.

In addition to the complete prohibition on flavored vapor products, pharmacies and stores containing them have been barred from carrying any non-therapeutic nicotine products. Retailers found in violation of either law are subject to a potential fine of up to $100 per item in question.

According to data from the Vapor Technology Association, the measure is set to shutter nearly 700 small mom-and-pop vape shops forcing over 6,000 people into unemployment during one of the worst economic periods in history. Additionally, the state is projected to face a near $680 Million budget shortfall as a result of the loss of tax revenue from these sales and businesses.

Anti-vaping activists and other supporters of the ban believe it is necessary to protect children and teens from potential nicotine addiction. Their claims come despite evidence finding that a majority of teenagers don’t actually vape, and that smoking rates are at historically low levels.

This type of shadow governance is a slap in the face to the democratic process and freedoms that we all hold dear.

The chaos created in the wake of the coronavirus crisis is looking like a devastating deathblow to an already injured industry. While most regulators and public health officials scramble to contain the contagion, others are choosing to focus their efforts elsewhere.

A proposed complete ban on all flavored nicotine products recently advanced out of the Senate Health Committee in California. In addition, a new tax on nicotine has been included as a part of the Governor’s upcoming budget proposal.

Vape shops throughout the state are in fear for the future of their businesses and the industry as a whole as both proposals gain momentum. The industry has struggled to adapt to a rapidly-changing and increasingly-hostile regulatory environment and has been absolutely devastated in the wake of the coronavirus crisis and associated lockdowns that have forced closures throughout California.

Vapers in the state are concerned for their own health and futures as well. Many are worried that a lack of access may force those addicted to nicotine to take up smoking again, and the strict scope of the ban would lead to an increase in risky black-market alternatives.

War Against Vaping

In California, SB 793 passed out of the Senate Health Committee at a vote of 8-1 and is now set to advance to the Senate Appropriations Committee for additional review. The proposed bill would ban retail sales of all flavored vapor and tobacco products within the state.

Additionally, Governor Gavin Newsom has included a tax on nicotine as a part of his budget proposal for the fiscal year ahead. The proposal would create an additional tax on nicotine products at a rate of $2 per 40mg, alongside the state’s staggering 60% wholesale tax on vapor products.

Move Places Company Closer To Regulators Making Lobbying Easier

Embattled vapor company Juul Labs has been engulfed in controversy following investigations, lawsuits, and regulatory crackdowns over their marketing practices allegedly targeting teens. Following announcements of expected layoffs and considerations to exit multiple international markets, the company has also decided to move their corporate headquarters to be closer to regulators.

Less than 18 months leasing a 20,000 square foot space in the heart of the Mission District, Juul Labs is planning on moving its corporate headquarters from San Francisco to Washington, D.C. According to reports, the company is planning the move as a way to be closer to legislators and Food and Drug Administration officials.

While largely a symbolic gesture, the move does give lobbyists working directly for and on behalf of the company better access to lawmakers and other officials. This may allow the company to better position itself in the wake of investigations and ensuing regulatory crackdowns.

Juul is expected to maintain office space in San Francisco for their product and software development teams. The company leasing the space to Juul Labs has stated that the company is not in talks for an expansion in the building, which is currently fully leased.

SF To DC

Juul Labs, manufacturer of the popular Juul vaporizers and cartridges, is planning to relocate its corporate headquarters from San Francisco to Washington, D.C., according to a report by The Wall Street Journal. The move comes shortly on the heels of reports that the company would be downsizing by nearly a third and planning to exit multiple international markets as part of a larger restructuring effort.

According to a source at Altria, the relocation is a symbolic gesture meant to signal the company’s commitment to change to public health regulators. In addition, the move is meant to symbolically serve as a way for the company to separate itself from the culture of exponential growth that consumes Silicon Valley.

Two years ago the company faced a $38 billion valuation following the acquisition of a minority stake by big tobacco giant Altria, which has since lost nearly two-thirds of its value following a series of controversies regarding the company’s marketing practices. The company has remained in a constant cycle of investigations and lawsuits over allegations that Juul was being directly marketed to children and teens.

The restructuring efforts come as a way to better position itself for the future, according to CEO K.C. Crosthwaite. Crosthwaite replaced former CEO Kevin Burns in late 2019 as investigations and lawsuits began to gain traction, and has since put a stop to the company’s rapid overexpansion.

Researchers Currently Exploring Connection Between Nicotine Consumption And Lowered Risk Of Contracting Coronavirus

New evidence indicates a possible connection between nicotine consumption and a lowered risk of contracting the coronavirus and developing COVID-19. This connection was discovered after a survey of confirmed coronavirus cases found that a statistically significantly low number of patients were actually smokers despite high prevalence among the general public. Benefits Of Nicotine?

French researchers are looking to explore a possible connection between nicotine usage and a lowered risk of contracting the coronavirus. Neurologist Jean-Pierre Changeux theorizes that nicotine may be potentially preventing the virus from infecting cells directly, or could be lowering the body’s immune system to prevent an overactive immune response.

An initial study was conducted through surveys at the Pitié-Salpêtrière Hospital in Paris and found a statistically significantly low prevalence of confirmed coronavirus cases among smokers. Researchers now plan to distribute nicotine patches to frontline workers and intensive care workers in a clinical trial to further explore this potential connection.

France’s findings confirm a previous study from China in March, which also found that only a small percentage of confirmed cases were smokers, despite higher smoking rates among the general public. Even a study released by the CDC in the USA found a remarkably low amount of smokers had contracted coronavirus, although the United States has far lower tobacco usage than either France or China.

“Our cross-sectional study strongly suggests that those who smoke every day are much less likely to develop asymptomatic or severe infection with Sars-CoV-2 compared with the general population,” the Pitié-Salpêtrière report authors stated in the study. “The effect is significant. It divides the risk by five for ambulatory patients and by four for those admitted to the hospital. We rarely see this in medicine,” they added.

What It Means

Manufacturers Allowed To Continue Selling, Marketing Products In Interim

The chaos caused by the coronavirus had led to mass delays and cancellations throughout the world. While obvious candidates such as sporting events and concerts have been pushed back or outright ended, less obvious events such as governmental reviews are being moved as priorities rapidly shift.

The Food and Drug Administration announced a delay in the federal premarket review process for vapor products and devices. The delay further sets back what would be essentially a full federal ban on most vapor products, unless they meet strict FDA criteria for public health that many cessation aids simply can’t meet.

The previous deadline for manufacturers to submit applications for their products to the agency for review was May 12th, after anti-vaping activists had sued the FDA to expedite its review process. The new deadline is now set for September 9th, although that may easily be delayed further as the pandemic rages onward.

The premarket review process for vapor products and devices represents a portion of the FDA’s larger efforts to regulate the vapor industry. The regulatory crackdown came after vocalized concerns by anti-vaping activists over youth access to vapor products and questionable marketing practices by companies such as Juul.

Federal Ban

The United States Food and Drug Administration has announced it will delay the application deadline for its premarket review process for vapor products and devices. While manufacturers previously had until May 12th to submit applications for their products to the FDA for review and approval, companies will now have four additional months, until at least September 9th, to conduct the necessary research and paperwork.

The commissioner for the agency has stated that priorities have shifted in the wake of the outbreak, and that staff who would have previously worked on the premarket review process are currently assisting with the agency’s pandemic response. In addition, many companies involved in the review process have reported a series of difficulties with completing research due to various travel restrictions and limited lab access.

The FDA premarket approval process for vapor products and devices requires companies to submit detailed information on the design and effects of their products to determine their risks and benefits to public health at large. As a form of enforcement discretion, the agency is allowing products subject to review to continue to be sold and marketed illegally.

Many companies are viewing the delay as a promising sign for the industry, who is struggling to adapt to a rapidly shifting and increasingly hostile regulatory landscape, alongside the basic challenges posed by an unfolding global pandemic and the economic fallout that follows it. Fear-Mongering Misinformation Causing Confusion And Mistrust?

There is a lot of misinformation surrounding the current coronavirus and associated ongoing pandemic. While there is still much we don’t yet know about this novel virus; new information emerges each day that appears to supersede or contradict previous information.

The US Food and Drug Administration recently announced a shift on their stance regarding vaping and COVID-19. The agency is now stating that the risk is unknown for vapers with coronavirus, while standing-by statements of an increased risk of complications for smokers.

The agency had previously conflated vaping with smoking, stating that both were at risk of increasing potential complications of the coronavirus. Public health scholars and harm reduction experts immediately spoke out against this, noting there was no evidence of complications from vaping at all.

During trying times, people often turn to their officials for reassurance and factual information. The constant barrage of changing and often contradictory information coming from officials is rapidly sowing discord and distrust among the public, during a time when people need them to be honest the most.

Lies About Vaping

The United States Food and Drug Administration shifted its stance on the coronavirus and vaping, stating that potential risk is unknown for vapers while continuing to caution against an increased risk of complications for smokers. The agency had previously stated that vapers and smokers faced an increased level of risk of complications from the novel coronavirus and that these users tend to face worse outcomes.

Iowa Attorney General Tom Miller had previously written a letter to agency officials criticizing the initial conflation, stating that the agency’s stance was fear-mongering and a “regrettable episode.” He notes that this conflation can create a negative perception among the public that may dissuade people from trying vaping to help them quit smoking, which is all the more important now due to a heightened risk of complications from COVID-19.

“Where is the evidence-based reasoning that advising adult smokers against vaping is appropriate for the protection of public health at any time, but especially during this COVID-19 crisis? We know of no relevant and informative evidence on vaping and COVID-19, and the evidence on smoking and COVID-19 is inconclusive and contradictory,” Miller stated. The letter was co-signed by over a dozen public health and policy experts, including representatives from the Drug Policy Alliance and American Heart Association.

In addition to the misinformation, the letter was also highly critical of the way the agency chose to disseminate their message, noting that they opted to email a single organization rather than presenting evidence publicly. The resulting article published in Bloomberg fails to cite any studies noting any connection between the two.

“We heard about a local hospital chain that was literally struggling to supply their doctors and nurses with hand sanitizer,” said Annette Rogers, operator of Kai’s Virgin Vapor. “People in areas hit hard by the coronavirus aren’t able to find it.” As the company’s production facility already had mixing and bottling equipment, alongside a decade of experience in laboratory quality control, they were able to rapidly adapt and shift their focus to help meet a critical need.

These companies are not only providing a public service but have found a way to remain solvent and retain their staff during a time of heightened economic uncertainty. “Most of the employees you see are employees we already had at the lab and/or people who were laid off from their jobs that we brought on here to help us during this crisis,” said Darrell Suriff, CEO of the American Vapor Company.

While donating a majority of their production to healthcare workers and people in need, a portion of their products is available for sale to the general public to help meet demand in the private sector as well. Claims Of The Government Picking “Winners” And “Losers” With Stay-Home Orders

The coronavirus pandemic has forced much of the economy to temporarily halt as the world scrambles for containment. While businesses deemed non-essential are being forced to temporarily shutter, a band of small businesses continue to remain open.

A group of vape shops in San Antonio has outright refused to comply with the city’s “Stay Home, Work Safe” order thus far. Violations of the order are punishable by a fine of $1000 or a jail sentence of up to 180 days.

They claim that the government is being selective in what it deems to be essential, with businesses selling tobacco products allowed to remain open, but vape shops being forced to close in a majority of jurisdictions. Economically it’s not even at a point of businesses turning a profit, but just being able to make payroll.

Law enforcement and legislators have received a number of complaints pertaining to order violations, although they’re currently limiting enforcement for obvious offenders. The order has remained a point of contention, with many left uncertain about what exactly is considered essential and how to even go about enforcing it.

Essential Businesses

In San Antonio, a small group of vape shops is?actively resisting?the city’s “Stay Home, Work Safe” order. They claim that the order actively chooses economic “winners” and “losers,” and that their businesses should be given the opportunity to adapt. “It’s absolutely outrageous what is happening here,” said Brad Bennett, owner of Mega Vape. “If a restaurant can do curbside if a pet shop can do curbside, why can’t a vape shop do curbside?”

Across the City, Texas Vape owner Richard Tisdale puts up the same fight, adding a disinfectant to his inventory in an attempt to skirt regulations. “I’m not going to get out of here. My lawyer told me I don’t need to get out of here,” Tisdale said. “I’ve got too many deliveries, still coming. I’m not closing the business. I’ve already paid for all this product coming in. I have to be here.”

Since the order had been issued, the San Antonio Police Department stated it had received over a thousand complaints of violations. Violators face fines of $1000 and up to 180 days in jail; city officials are hoping that businesses comply with the order voluntarily.

“I’m not suggesting we need to start going and indiscriminately just start pounding this home,” said District 8 Councilman Manny Pelaez. “I’m looking for flagrant violation opportunities to remind folks, right?” City officials have since visited both outlets and issued written warnings for the violations, but enforcement action has yet to be taken.

Industry Raises Important Questions Over What Should Be Deemed Essential During A Crisis

An unfolding pandemic centered around a novel strain of coronavirus has brought the entire world to a screeching halt. As businesses are ordered to temporarily shutter as a means of helping to slow the spread of the outbreak, questions are being raised over what should be deemed essential and allowed to continue operating.

Denver has recently been placed under a stay-at-home order by its mayor in response to the ongoing crisis. While exemptions have been made for dispensaries and liquor stores as essential retail allowed to keep operating, vape shops have been excluded despite the public health promise it provides.

Members of the vaping industry and community within the city and broader state have expressed concern and disappointment with the exclusion. They note that if alcohol and recreational marijuana are essential, helping adults quit and remain off, tobacco should be as well.

The mayor’s office has defended the decision and hasn’t announced any plans to allow an exemption for such outlets. The office cites determinations by other agencies that deemed vape shops to be nonessential, and note the lack of public demand compared to alcohol and recreational marijuana.

Essential Services

On March 24th, Denver Mayor Michael Hancock issued a public health notice for the city. This included an explicit “stay at home” directive for its citizens, which temporarily shutters any businesses deemed nonessential by the administration.

While exemptions have been made for liquor stores and marijuana dispensaries, which have been deemed essential for the continuation of society, a similar exemption has not been made for vape shops. This has left the industry fuming over the decision, stating that helping adults quit and remain off of tobacco is more essential to society than pot and booze.

“If alcohol and recreational marijuana are essential services, we believe that responsible adult vaping consumption is an essential service, too,” Amanda Wheeler, vice president of the Rocky Mountain Smoke Free Alliance, said in a statement. “This is a health issue, as many of our customers are former combustible cigarette smokers looking for a healthier alternative to smoking. When you take away that option, it has real health implications.”

The mayor’s office issued its own statement in response to these criticisms, stating that “vape shops were determined by the City Attorney’s Office and Denver Public Health and Environment to not be an essential business during this public health emergency,” spokesman Michael Strott stated in an email. “Public demand also factored into the decision by public health officials to exempt liquor stores and retail marijuana shops — as evidenced by the unsafe numbers of people who gathered in lines at those businesses, but not vape shops.”

Vaping has been demonstrated to provide several public health benefits, such as successfully aiding millions in smoking cessation and being a reduced harm alternative to smoking. Industry groups argue that these benefits alone should allow an exemption for vape shops, alongside a litany of perfectly valid claims.

These organizations are concerned that forcing vape shops to close may force those addicted to nicotine back toward smoking, higher nicotine vapor products at exempt retailers, or even black market options. They’ve also raised concerns about the potential additional strain such moves may place on an already overwhelmed healthcare system.

Following the blocking of a previous ban by the New York State Supreme Court, Cuomo pushes onward with his anti-vaping agenda

An upcoming budget proposal in New York seeks to implement a series of prohibitive policies targeting vaping. The measure would ban the sale of all flavored vapor products, any advertising, as well as online sales and selling vapor products within pharmacies.

Harm reduction experts continue to caution that such broad bans are actually detrimental to public health at large by restricting access to a safe and effective smoking cessation device. Anti-vapers continue to claim that such measures are the only effective way to prevent teenage access to vapor products.

Cuomo’s previous ban implemented under executive order had been struck down due to legal challenges behind its implementation, with the ruling judge stating, “the emergency regulation is an impermissible administrative transgression into territory that is reserved to our Legislature by the state Constitution.” The new ban has been introduced as part of an upcoming budget proposal, where it would be subject to legislative scrutiny, unlike the executive order.

Proposed Prohibitive Policy?

Governor Andrew Cuomo announced new plans for a ban on flavored vapor products, despite having his prior arrangements for a ban on flavor vapor products blocked by the state Supreme Court. As mentioned, the new ban would prohibit the sales of all flavored vapor products, vaping-related advertising, all online and mail-order vapor sales, the sale of vapor products in pharmacies, as well as regulate the use of carrier oils in vapor products.

The ban was blocked due to issues with its implementation, with the ruling judge finding the emergency regulation to be an abuse of the executive branch.

“Bill Bans All Flavored Vaping Products While Leaving Tobacco Products Untouched”

The Oregon State Legislature is set to become the next front in the state’s ongoing war against vaping. Following the failure to implement a temporary ban through executive order, lawmakers are now proposing permanent regulations restricting access to any flavored vapor product.

Lawmakers have proposed a bill that would ban all flavored nicotine vaping products with the exception of tobacco. The proposed legislation would make Oregon one of the most restrictive states in the nation in regards to vaping.

Small mom-and-pop vape shops throughout the state have attempted to plead with legislators, stating the proposed ban would force them to close, potentially costing the state hundreds of jobs and millions in tax revenue. Some anti-vaping activists have stated the proposal doesn’t go far enough, and that only the outright prohibition of all vapor products will successfully end teen vaping.

It’s important to note that claims of a teenage vaping epidemic have been debunked by a multitude of studies, and rebuked by harm-reduction experts and public health scholars alike. In addition, nicotine vaping has been exonerated as a potential culprit in a series of vaping injuries that occurred during mid-2019.

Complete Flavor Ban

State Senator Laurie Monnes Anderson proposed legislation that would ban the sale of all “flavored inhalant delivery system products,” which means any flavored nicotine vapor product that isn’t tobacco-flavored or flavorless. The ban would not include cannabis vapor products or products approved by the FDA to aid in smoking cessation.

The proposed legislation comes following the blocking of a previous temporary ban enacted through executive order by Governor Kate Brown. Because the temporary ban was successfully struck down in court by the vaping industry, lawmakers are seeking more permanent regulations.

An additional proposal in the state’s House would ban internet, mail, and telephone sales of vape products in Oregon, a measure the local industry actually agrees with. Most retailers within the state would not be affected by such a measure.

They note that more common-sense measures such as restricting sales to 21 and over retailers would strike a healthier balance between industry well-being, consumer needs, and the safety of youth.

Members of the industry and community have hailed the results, noting other studies that have shown few teens even try vapor products. Anti-vaping activists decried the findings, stating the study doesn’t align with the current narrative surrounding vaping.

The research falls in line with sentiments from public health scholars and harm-reduction experts, who have long cautioned against the various forms of prohibitionist policies that have been implemented throughout the country. They warn that flavor bans are detrimental to public health by forcing former smokers back to tobacco or to the black market.

Debunking The Myth

A study led by researchers at NYU School of Global Public Health finds most teens do not vape, and even less do so daily. The study, published in the journal Nicotine & Tobacco Research, finds that over 85% of teens do not vape at all, and among the few that do, the majority are not daily users.

Researchers analyzed the results 2018 National Youth Tobacco Survey, which asked over 20,000 teenage participants about their use of tobacco and vapor products over the previous 30 days. The authors caution against reactive regulations based on fear and not fact, noting their potential harm to public health. “We need to avoid prohibitionist regulations like banning e-cigarettes—while leaving much more deadly cigarettes and cigars in corner stores—and instead should consider strong enforcement of age 21 sales restrictions. Prohibition creates a black market for vaping products or inadvertently pushes individuals back to smoking tobacco.” said David Abrams, co-author of the study and professor of social and behavior sciences at NYU School of Global and Public Health.

Proposal Faces Public Pushback In “Live Free Or Die” State

The United States vaping industry is facing an uncertain future following an upcoming federal ban on flavored vapor pods, as well as a wave of state and municipal restrictions. While several bans have been enacted with little public pushback, vapers in the “live free or die” state are refusing to go down without a fight.

A bill to ban all flavored vapor products, excluding menthol, went before a New Hampshire House committee Wednesday. Lawmakers have cited claims that New Hampshire teens vape at twice the average rate, and are attempting to curb that statistic.

Anti-vaping activists state that flavor bans help prevent teenage vaping by removing flavors that may appeal to them. Public health scholars have warned against flavor bans, noting that flavored offerings entice smokers to make the transition to vaping and keep them away from cigarettes.

Vapers and vape shop owners in New Hampshire have spoken out against the ban, stating such a move would decimate the local industry and place current and former smokers at risk. New Hampshire’s ban is even set to go farther than an upcoming federal ban by the Trump Administration, which only impacts closed-system devices such as Juul and Vuse.

Poor Prohibitive Policy?

New Hampshire vapers and vape shop owners came out to speak out against a proposed flavor ban in the state. One by one, former smokers turned quitters took their turn before a house committee to voice their disapproval against a proposed ban that impacts something that has provided so much benefit to their health and lives.

“I’m 34 years old. Cap’n Crunch berries and pineapple grapefruit, these two things are keeping me off cigarettes,” said Steve Kaltsis, owner of a Pelham vape shop. Kaltsis had been a pack a day smoker for over a decade before vaping finally broke him of his cigarette addiction.

Rep. Jerry Knirk, sponsor of the bill, wants to go beyond a recently announced federal ban on flavored vapor cartridges, by banning all flavored vapor products with the exclusion of menthol. He has stated that this ban will help to prevent teenage vaping by restricting access to flavors that may appeal to them in the first place.

Harm reduction experts and public health scholars have long cautioned against flavor bans, noting the significant negative public health ramifications for doing so. They argue that flavor bans ultimately result in limited options for e-cigarettes while offering an increased choice among cigarettes, which may deter smokers from quitting and could turn quitters back into smokers.

Conclusions

While state and municipal flavor ban proposals have seen pushback from their respective vaping industries and communities, residents in the “Live Free or Die” state are showing the effect that sustained civic engagement, and informative civil discourse can have. These vapers are helping to set a standard for vapers throughout the country, and sending hope that their voice truly does matter.

While the pushback has garnered a fair amount of attention in the press, there is still much work to be done for vapers in the state. The bill is set to move out of the committee before the house in the upcoming weeks, where it currently holds bi-partisan support.

The vaping industry and community in New Hampshire and throughout the United States must remain steadfast in their commitment to object such overreaching regulation. Continuing a campaign of sustained civic engagement and informative civil discourse is the best bet to help shift public perception and media scrutiny in favor of vaping again.

How The Viggo Handled

The Viggo is a fantastic little device that does everything it’s supposed too quite well. Common Sense Regulation Aims To Prevent Youth Access To Nicotine Products

While claims purporting a teenage vaping “epidemic” tend to be overblown, there has been a rise of experimentation with vaping among some riskier teens. In response to this, and following outbreaks of injuries initially attributed to e-cigarettes, but later found to be caused by vaping illicitly-produced spiked cannabis oils, lawmakers throughout the United States have enacted reactionary forms of regulation prohibiting vapor products.

While prohibitionist policies would, in theory, prevent teens from vaping by restricting sales, these various bans only end up harming adult smokers looking to quit by blocking access to a proven and effective smoking cessation device as opposed to actually protecting minors. Public health experts have begun speaking out publicly against these policies, noting the potential negative ramifications they pose to public health at large.

As a part of a larger spending bill, Congress has passed a new law that will raise the federal minimum age to purchase any nicotine-related products from 18 to 21. President Trump is expected to sign the bill, as he expressed support for such a move back in November.

Members of the vaping industry and community, public health experts and officials, and even anti-vaping activists have all expressed support for the move. This includes the increasingly rare bipartisan support among lawmakers. This simple and common-sense regulation most effectively prevents teenage access to nicotine-related products, without restricting adult access to vapor products to help aid in smoking cessation.

Common Sense Regulation

A new law passed by Congress as a part of the 2020 spending bill will raise the minimum age of sale of nicotine products from 18 to 21 in the upcoming year. The bill will now advance to the President, who had previously supported doing so after backing away from a proposal to implement a federal ban on flavored vapor products.

The spending bill had passed both the House of Representatives and Congress with little pushback, ultimately passing with a 297-120 margin. The new law is set to go into effect roughly nine months after the President signs off on it.

So far, 16 states, as well as the District of Columbia, have raised the minimum age for purchase to 21 under their own volition. In addition, various municipalities and localities scattered throughout the country have enacted regulations increasing the age anywhere from 19 to 21.

Federally increasing the age of purchase for nicotine products may help in overturning prohibitionist policies such as flavor bans that have been enacted on the state and local level. Current research shows that not associating nicotine with tobacco is a significant driving force in helping former smokers continue to abstain.

According to Public Health England, officials concluded that vaping is 95% safer than smoking, a figure the country’s public health agency routinely defends.

Furthermore, it appears there is little to no long-term risk to users of vapor products. In fact, a report from the National Academy of Sciences concluded that not only is vaping less harmful than smoking, but there are no long-term health effects associated with prolonged usage.

Implications

Federally increasing the minimum age to purchase nicotine-related products from 18 to 21 may help to overturn and deter prohibitionist policies restricting adult smokers’ access to vapor products. By effectively restricting teen access, bans on vapor products would be even more excessive and unnecessary than they currently are.

This common-sense regulation, with unanimous support across the spectrum of the vaping debate, will more effectively lower teenage vaping rates than any various ban has to date. This may signal to lawmakers that prohibitionist policies restricting adult smokers’ access to effective smoking cessation devices has many more drawbacks than benefits.

While a step in the right direction for the industry, it is important for the community not to become complacent with progress. Vapers must continue to speak out in defense of the tool that managed to free them from the binds of smoking.

The backlash faced by vaping has been completely isolated to the United States, with no similar reports of illnesses coming from any other country. As vaping faces a looming federal ban there, officials in the United Kingdom have continued to stand behind vaping as a valuable public health tool.

Smoking Cessation Aid

Research published in the journal Addiction finds vaping helped between 50,000 to 70,000 British smokers quit in 2017 alone. Researchers found that smoking cessation rates climbed as vapor device usage increased from 2011 onward.

The study was funded by Cancer Research UK and carried out by researchers from University College London. Figures were based on data from the Smoking Toolkit Study, monthly surveys of people 16 and older, going as far back as 2006.

While vaping does have the support of UK public health officials who see its value as a smoking cessation aid, the larger public health community has yet to see this value. The World Health Organization has yet to endorse vaping for smoking cessation, stating that scientific evidence on e-cigarettes as smoking cessation is not yet conclusive.

The study shines light on a dark time for vaping in general, as public health scares have led to an intense regulatory crackdown in the United States. Studies like this may be valuable in helping to shift the public perception about vaping in a more positive direction.

President alters the direction in light of new information regarding the economy and reelection prospects.

To say that it has been a chaotic couple of months for vaping as a whole is a dramatic understatement. As several state bans on vapor products face challenges in the courts, a proposed federal ban on flavored vapor products appears to have been abandoned.

President Donald Trump has reportedly backed away from his administration’s proposed flavor ban that was announced only two months prior. The President refused to sign off on an order that would have set the ban in motion despite the necessary approvals and regulatory framework already being laid out.

Members of the vaping industry and community commended the President for his reasonable approach to vaping and noted that legislators should enact sensible regulations before resorting to outright prohibition. Anti-vaping advocates decried the change in position, stating that parents are concerned about youth access to vapor products.

The administration’s change in position is a bright light in dark times for the vaping industry. While a major victory, there are still several state and local bans proposed the industry must navigate going forward.

President Changes Course

On September 11th, the President had initially proposed a federal ban on all flavored vapor products, including mint and menthol. By November 4th, the President had reportedly backed away from the proposal with anonymous sources within the White House citing economic and electoral concerns as reasons for the change.

Brad Parscale, Trump campaign manager, highlighted polling data to the President, showing that vaping may be a hot-button issue in key battleground states and that a ban may cost him voters. Campaign aides also showcased the vocal backlash against the proposal, both online through trending hashtags such as #IVapeIVote, and in person at events in the capital held by industry organizations.

Tony Abboud, executive director of the Vapor Technology Association, noted that bans do not work and “never have” in a statement to reporters. Critics such as Matt Myers, President of the Campaign for Tobacco-Free Kids, said the move was an example of poor politics and public policy.

The President has stated his administration is looking into alternative approaches to restricting youth access to vapor products, such as federally raising the minimum age of purchase from 18 to 21. For now, any plans to restrict adult access to flavored vapor products appear to be off the table.

Between investigations by multiple state and federal agencies, numerous state vaping bans, a looming federal ban on all flavored vapor products, as well as continually being accused of creating a vaping epidemic, vaping industry giant Juul Labs has seen better days. Despite the constant regulatory scrutiny, Juul has remained a steward of the industry and pioneer in innovative self-regulation.

In an effort to appease regulators and anti-vaping activist organizations, the company has proactively gone and voluntarily halted the sale of many of its flavored vapor offerings, including creme, fruit, berry, and mango. For critics, the company has controversially decided to continue the sale of its mint, menthol, and tobacco flavored pods.

Critics, such as the organization Campaign for Tobacco-Free Kids, note that mint and menthol have been used for decades by tobacco companies to potentially entice teens to smoke. The company has defended the move, stating it is an attempt to help rebuild trust in the vapor industry that helps combat teenage vaping while providing an alternative to adult smokers.

Last year the company voluntarily pulled all flavor offerings from retail outlets, only offering them for sale through its age-restricted website. Outside the United States, the company continues to provide and market its entire line of flavored vapor products, including cucumber, berry, and vanilla.

Industry Pioneer

In a statement, Juul Labs announced it would be halting sales of all flavored pods excluding mint, menthol, and tobacco. In addition, the company has agreed to cease lobbying efforts and has ended all digital, print, and television advertising.

The company stated the move was to help restore faith in the vaping industry by proactively working with regulators. “We must reset the vapor category by earning the trust of society and working cooperatively with regulators, policymakers, and stakeholders to combat underage use while providing an alternative to adult smokers,” said current Juul CEO and former Altria executive KC Crosthwaite.

Anti-vaping activists claim the move doesn’t go far enough, stating mint and menthol flavors have been used for decades by tobacco companies to lure potential teen smokers. “Juul’s decision to keep mint- and menthol-flavored e-cigarettes on the shelves is a page right out of the tobacco industry’s playbook.” said New York Mayor Michael Bloomberg, who is currently spending $160 million on an initiative to help curb teenage vaping.

Industry analysts note that mint and menthol account for 85% of retail sales, Juul does not provide figures for its online sales. Outside the United States, the company continues to offer a full line of products for sale both online and in retail outlets.

Juul has pulled its flavored product offerings ahead of looming state and federal bans on flavored vapor products. Research indicates these bans may have serious negative public health ramifications, such as a study from Yale University that found former smokers who can’t access flavored vapor products may end up taking up smoking again.

While a so-called teenage vaping epidemic is often cited as the reason for flavor bans, current research indicates these claims may actually be dramatically overblown. In a review, Action on Smoking and Health found as little as 0.1% to 0.5% of teens who even try vaping actually end up it doing habitually.

Implications

Juul Labs has been working closely with regulators to ensure adult smokers have safe access to a proven smoking cessation tool while also preventing teens from vaping. The company is currently in the process of conducting clinical trials on its product line to submit for review to the FDA, which has given vapor product manufacturers until May 2020 to submit for review products they wish to remain on the market.

Flavor bans have been shown to have major negative public health ramifications, as restricting adult, smokers access to a proven effective smoking cessation tool may lead them to continue smoking and only exacerbates the smoking epidemic. In addition, these bans have also been shown to have negative economic impacts, as flavored vapor products make up 90-95% of sales for retailers, and these bans significantly impact their bottom line.

As Juul Labs has voluntarily agreed to stop lobbying lawmakers, it is imperative for the rest of the vaping industry to stand together to push back against overreaching regulations such as flavor bans. Furthermore, members of the vaping community must remain civically engaged in helping convince lawmakers of the promise that vaping holds. Vapers sharing stories about how it has impacted their lives and allowed them to quit using hashtags such as “#IVapeIVote” are a great way to help shed some positive light on vaping as a whole.
